The largest Government Fraud and Corruption ever perpetrated, that no one will report on

This is a developing investigation. Any attempts by any agency to repudiate will result in additional questions being publicly asked here.

We are very interested in suing any and all of the subsequent named and implied. If you or someone you know is interested in representing the crime victims of the "Camp Fire" please get in touch with me.

Why not ask questions here before hand? I don't trust the agencies and want to provide as little time as possible for fraudulent documents to be manufactured.

If something doesn't work, please let me know, I should have backups stored at a number of locations outside of my house should there be another #FraudFire.

Facts

  1. A crime victim is codified as "...a person who suffers direct or threatened physical, psychological, or financial harm as a result of the commission or attempted commission of a crime or delinquent act." California Constitution Article 1, section 28(e)
  2. Why has the State of California never informed crime victims of PG&E fires of their rights as required by California Penal Code § 679.026(b) and California Penal Code § 679.026(c)?
  3. After using 100 year old equipment and PG&E having not been compelled by the State (CalFire [California Public Resources Code § 714(d)] or CPUC) to maintain "four feet of separation around power lines in high fire-risk areas is required," with a "minimum 12-foot clearance at the time of the trim is recommended to ensure year-round compliance;" approximately a month and a half before the 2018 "Camp Fire", rather than utilizing existing hotel/motel infrastructure, PG&E created a massive 3,000+ person camp outside of the town limits. As residents from multiple communities would need places to stay, the PG&E camp would conveniently be repurposed to provide FEMA employees a place to stay without utilizing the surrounding hotel/motel infrastructure that crime victims would need to pay to use.
  4. As codified by, 11 U.S.C. § 101(6); in terms of: "futures commission merchant"(11 U.S.C. § 761(9)(A)), "commodity options dealer"(11 U.S.C. § 761(6)), and possibly "foreign futures commission merchant"(11 U.S.C. § 761(12)), PG&E is by definition a "commodity broker". In accordance with 11 U.S.C. § 109(d), PG&E is prohibited from chapter 11 and restricted to chapter 7.

    * Page 31: "PG&E bought and sold physical natural gas on the Intercontinental Exchange (ICE) and the ICE Natural Gas Exchange (NGX) physical clearing service. ICE is an electronic system that matches buyers and sellers of natural gas products. Once buyer and seller are matched, ICE trades become bilateral trades. ICE/NGX trades are cleared by NGX rather than bilaterally. Transactions include forward transactions with deliveries starting within the next quarter and up to one quarter in duration, monthly, BOM, day-ahead, and same-day."

  5. PG&E exceeded the debt limit imposed by 11 U.S.C. § 109(e); established as applying to chapter 11 in accordance with: In re Nichols, 384 B.R. 881 (Bankr. N.D. Ohio 2008) and In re Decker, 465 B.R. 433 (Bankr. D. Kan. 2012).
  6. PG&E's delinquent act of using equipment from 1919 lead to PG&E's commission of a series of crimes including unlawfully causing a fire. PG&E violated federal bankruptcy law 11 U.S.C. § 109(d) by being allowed to chapter 11 even though as a commodities broker PG&E is prohibited from chapter 11 and restricted to chapter 7. Over 50,000 people suffered direct, threatened, physical, phychological, and financial harm as a result of PG&E's acts. Despite the $6.75 billion dollar aggregate settlement with stock that was illegally accepted, people have and continue to suffer financial harm to this day as a result of PG&E's efforts to illegally file chapter 11 and pay an insufficient amount of money to the point where people are NOT justly or timely receiving money thereby still suffering psychological and financial harm as the result of the commission of a crime.
  7. Any relief arising from these efforts should only be provided to crime victims as codified above, NOT to the contrived terminology of "fire victims" and "fire survivors".
  8. If a person is paid to annually do a job, has no intentions of doing it [for several years], and in fact does not do it [for several years], that's fraud. And if the government is the payer / buyer of services using our tax dollars, that is defrauding the government. 18 U.S.C. § 371, 18 U.S.C. § 1349, 18 U.S.C. § 1001. Possibly 18 U.S.C. § 286
  9. At least 58 of the 92 largest fires from 2015 - 2021 have arose on State (federal, California, municipality) land.
  10. I have not talked to a single person from any fire (2015, 2017, 2018, 2021) that has ever been informed of their rights as required by law.
  11. US Forest Service knew the "Dixie Fire" would burn from July 16, 2021 through September 30, 2021; and it did, ultimately destroying the community of Greenville, CA.
  12. People have asked what could have been done with the winds on the day of the fire:
    1. PG&E could have done what they warned us they were going to do two weeks prior and turned off the electricity.
    2. CalFire could have done fire prevention work that CalFire is statutorily responsible to enforce, California Public Resources Code § 714(a).
    3. CalFire could have made the other government agencies which are paid to maintain the land actually maintain the land as CalFire is required by law to do, California Public Resources Code § 714(d)

How did it happen?

  1. Since at least 2015, Courts have repeatedly not considered public safety or the safety of school students when sentencing PG&E as required by California Constitution Article 1, section 28(a): (2), (4), and (7). In my opinion, these "judges" should have every case they have ever presided over reviewed and likely thrown out for blatantly violating public trust, public safety, and endangering school students. Erase and invalidate their life's work.
  2. Fraud California Public Utilities Commission (CPUC) did not oversee PG&E's equipment as part of their job which is why PG&E was using equipment from 1919.
  3. State of California knowingly and intentionally contributed to the drought with the use of "Shade balls" which were designed to stop 80-90% of water from evaporating thereby disrupting the "Water cycle"
  4. Fraud Bureau of Land Management (BLM), US Forest Service (USFS), and National Park Service (NPS) did not maintain the land that they are paid to maintain. Possibly statutorily responsible to maintain; this has not only given rise to the 2018 "Camp Fire," it also gave rise to the 2021 "Dixie Fire" that happened not far from where the Camp Fire happened.
    1. On August 16th, 2023 Congressman Doug LaMalfa admitted that US Forest Service did not do their job of clearing underbrush or maintaining federal land that US Forest Service is otherwise paid to maintain for "fear" of being "sued" by "environmentalists". LaMalfa subsequently went on to share his personal sentiments on how the federal government is too big; unless of course it is Doug LaMalfa and his cronies receiving millions of dollars in federal subsidies for their "agriculture". "Action News Now" was present to record LaMalfa. The problems with what LaMalfa said are:
      1. boots on the ground US Forest Service wouldn't be sued, the federal agency would be.
      2. I don't believe the government "fearing" the possibility of being sued warrants the government not doing the job that we paid the government to do with our taxes, especially without any kind of public alert.
      3. Someone had to decide the policy for US Forest Service to not do their job.

      In light of several government agencies defrauding the government by not doing the job we paid them to do with our taxes. In light of innocent Americans being burned alive from the government's wanton and willful negligence, we, the crime victims of these fires need to have a full FBI/DOJ investigation into why these agencies were not doing their job and who ultimately decided the policy that caused these fires and loss of life albeit to prevent these fires in the future.

      The SARS team(s) should also be asked to testify under oauth of what they personally witnessed and that testimony should be fully, unabridged, unredacted made public.

    2. November 27, 2023; seemingly a "threat" of being sued in and of itself is insufficient to change policy and that actual litigation is required; i.e., "Why environmentalists are suing the National Park Service to prevent it from planting trees"
  5. Fraud California Department of Forestry and Fire Protection (CalFire) did not provide fire prevention as statutorily required; California Public Resources Code § 714(a).

  6. Fraud California Department of Forestry and Fire Protection (CalFire) did not enforce forest and fire laws on BLM, USFS, or NPS as statutorily required; California Public Resources Code § 714(d).
  7. Fraud California Department of Forestry and Fire Protection (CalFire) did not provide initial air support, "Air resources had to wait until 30 minutes after sunrise, i.e., 7:14 a.m." yet in the 2022 Emerald Fire, "Four Cal Fire air tankers, five helicopters and more than 75 engines fought the blaze by mid-morning, OCFA Captain Paul Holaday said. The first call about the fire came in at 4:10 a.m. The initial response was robust, 'with several engines and aircraft,' Fennessy said. At one point, as the fire got closer to Emerald Bay, firefighters placed 'almost an engine in front of every home.';" the difference? A rural community vs multi million dollar beach front properties, who presumably make political contributions.
  8. "...firefighters for the most part never attempted to prevent the flames from entering Concow or Paradise..." yet CalFire saved Paradise Town Hall? Which did catch fire.

What has happened since?

  1. Fraud + Deprivation of rights Based on California Attorney General's official website*, former California Attorney General Xavier Becerra and several District Attorney Offices have broken the law, choosing to victimize victims of crimes by not informing crime victims of their rights as required by California Penal Code § 679.026(b) and California Penal Code § 679.026(c).

    * Under sections: "Does every victim have a right to receive a Marsy's Card or just victims of violent crimes?" and "When does the Marsy's rights card need to be given to the victim?"

  2. Fraud + Deprivation of rights Superior Court of California, County of Butte did NOT order restitution for all crimes victims as required by California Constitution Article 1, § 28(b)(13)(B); "Restitution shall be ordered from the convicted wrongdoer in every case, regardless of the sentence or disposition imposed, in which a crime victim suffers a loss." Such a violation of law seems like "Honest services fraud" (18 U.S.C. § 1346) to me.
  3. Fraud + Deprivation of rights Superior Court of California, County of Butte and Butte County District Attorney's Office violated California Constitution Article 1, § 28(b)(13)(C) by not paying victims first; "All monetary payments, monies, and property collected from any person who has been ordered to make restitution shall be first applied to pay the amounts ordered as restitution to the victim." Such a violation of law seems like "Honest services fraud" (18 U.S.C. § 1346) to me.
  4. Fraud In violation of Federal bankruptcy law, "Judge" Dennis Montali has allowed PG&E Company, a commodities broker to file chapter 11 bankruptcy twice, first in 2001 and again in 2019; "In addition, stock and commodity brokers are prohibited from filing under chapter 11 and are restricted to chapter 7. 11 U.S.C. § 109(d)".
    1. Chapter 11 seems prima facie unconstitutional. If natural people don't get the same benefit / protections, if natural people can't chapter 11, that seems to violate the Equal Protection Clause of the 14th amendment to the US Constitution.
    2. "Judge" Dennis Montali allowing PG&E Company, a commodities broker to chapter 11 twice is a pattern of Racketeer Influenced and Corrupt Organizations ("RICO") predicate offenses; specifically: bribery, dealing in obscene matter, fraud, obstruction of justice, bankruptcy fraud, securities fraud, and possibly: money laundering, commission of murder-for-hire, or acts of terrorism.
    3. In my opinion, "Judge" Dennis Montali violating federal bankruptcy law means that PG&E's chapter 11 is Fruit of the poisonous tree and has to be thrown out.
  5. Attorneys hired by the crime victims were allowed to illegally accept an aggregate settlement of $6.75 billion dollars with stock that was not unanimously accepted by the crime victims as required by: California Rules of Professional Conduct: Rule: 1.8.7.; i.e., Orange County Bar Association: Don't Forget the Aggregate Settlement Rule When Negotiating a Civil Settlement for Multiple Defendants. The 2018 "Camp Fire" was not tried as a class action, it was "tried" as a mass tort.

    The "news media" and attorneys for the crime victims are misrepresenting / false advertising the aggregate settlement as $13.5 billion dollars; the fact is it was a $6.75 billion dollar settlement with stock. Whilst the stock could be worth the remaining $6.75 billion, it could just as easily be worth $3.50. There is no guarantee of the value of the stock.

  6. Fraud Despite case law and statutes being cited, the State Bar of California has taken a hear no evil, see no evil, say no evil approach; effectively choosing to completely ignore complaints made by myself and others against members of the State bar.
  7. The government agencies, former California Attorney General, district attorney offices, "Judge" Dennis Montali and others seem to be guilty of Honest services fraud and likely other crimes.

Why did it happen / motive?

  1. Given that the decision for these agencies had to come from the top down; if the decision came from the bottom up, those people would have likely been fired / demoted / replaced, the two reasons I've thought of as to why governors and/or heads of multiple government agencies would choose to commit such blatant fraud are:
    1. Political contributions by the rich / wealthy.

      Given that the "news media" is owned by rich / wealthy and influenced through advertisements / sponsorships, this would also explain why the "news media" has so far refused to cover anything I've mentioned; the State victimizing 50,000+ crime victims isn't news in what country?

      Historically as was the case with the Centralia, PA mine fire and with several landslide litigation cases, the government has been liable for their actions and inactions, why wouldn't the government be liable for their role in creating the environment for these fires, depriving crime victims of their rights, or the laws that have been violated since the fires?

      1. Who is profiting from these fires? Did they make political contributions?
      2. Who has bought land in Paradise since the fire? Did they make political contributions? As determined by their luxury, non-practical vehicles, why are rich / wealthy people buying land in a town that pretty much doesn't exist and has lost its natural beauty?
      3. Who made political contributions to those who made these decisions?
    2. Governors and heads of multiple government agencies chose, on their own accord with no rhyme or reason to break the law, then in the furtherance of their crimes broke more laws.
    3. If you have other possible motives, please feel free to let me know. These are just what I've been able to think of.

What can be done?

  1. Talk to people via word of mouth as Facebook does seem to be censoring this
  2. Investigate, indict, and prosecute the people involved.
  3. Put pressure on your elected "representatives" for public answers
  4. Put pressure on the "news media" to accurately cover this
  5. Extend the statute of limitations; e.g., "President Biden Extends Statute of Limitations for PPP and EIDL Fraud to Ten Years".
  6. Inquiries on if the following Facebook admin/moderators are: 1) even crime victims, 2) why they're a part of so many Facebook groups for different fires, and 3) their motive for censoring substantiable facts:
